Bara Court Ordered 2 Accused Minors To Be Kept In Juvenile Correction Home During Trial, While Releasing One Adult On Rs 20,000 Bail, & 9 Others On Court Dates, And Rs 2 Lakh Relief Ordered For Her Family As Final Justice Is Still Awaited

BARA, NEPAL: Bara District Court had issued a preliminary order in the case involving the alleged r@pe and m*rder of three-year-old Garima Chaudhary, sending two minor accused to a juvenile correction home while the case continues through the legal process.

The court’s decision is a pre-trial order and not a final verdict. The final judgment will only be delivered after the court completes examination of evidence, witness statements, and legal arguments.

The case involves the death of a three-year-old girl from Jitpur Simara Sub-Metropolitan City-1, Bara, whose body was found inside an abandoned house after she went missing.

Court Separates Accused Based on Evidence and Age

During the initial hearing stage, the court reviewed the allegations, statements, and evidence submitted by the prosecution.

Two minor accused involved in the case were ordered to remain at a juvenile correction home until further proceedings.

The court’s decision follows the legal provision that cases involving children must be handled separately through the juvenile justice system.

Ten Adult Accused Receive Different Orders

Earlier, Bara District Court had issued different orders for the adult accused named in the case.

Among the accused:

• Progress alias Purgress Chaudhary was ordered to be released on Rs 20,000 bail.

• Nine other accused were allowed to continue the case on general date (sadharan tarikh) as the court found insufficient immediate evidence to keep them in custody.

Those released on general date include:

• Indrajit Chaudhary

• Babita Chaudhary

• Mamata Chaudhary

• Pushpa Chaudhary

• Navin BK

• Tek Bahadur Thapa Magar

• Shesh Hasmudin Alam

• Sabita Chaudhary

• Bindu Devi Chaudhary

The court clarified that these orders do not determine whether the accused are guilty or innocent.

Allegations Filed Under Serious Criminal Charges

The victim’s family had filed a complaint accusing multiple individuals of involvement in:

• Kidnapping

• Illegal confinement

• Sexual violence

• Murder

The prosecution had argued that some accused had played supporting roles or helped conceal evidence related to the crime.

However, during the preliminary hearing, the court said the available evidence against several accused was not enough at this stage to order detention.

Investigation and Evidence Review Still Ongoing

The court’s order only decides the conditions under which accused persons will face trial.

It does not represent the final outcome of the case.

The court will continue to examine:

• Witness statements

• Investigation reports

• Forensic evidence

• Other materials presented during the trial

A final judgment will be issued only after completion of the legal process.

Two Minor Accused Previously Linked to Investigation

During the investigation, police had stated that one minor accused confessed to taking the child away after offering her chocolate and later committing the crime.

Police said the statement was considered along with other investigation findings, including the location where the child’s body was found.

A video related to the minor’s statement was later circulated on social media, leading to action against a police personnel accused of leaking investigation material.

Background: Three-Year-Old Girl Found Dead After Going Missing

Three-year-old Garima Chaudhary went missing on Shrawan 31 from Jitpur Simara-1, Bara.

After a search operation, her body was found on Bhadra 2 inside an abandoned house at Bhaktinagar area.

The incident sparked public outrage, with protests held in Bara and Kathmandu demanding justice.

The victim’s family continues to await the final court verdict.

Relief Support Ordered for Victim’s Family

Along with legal proceedings, authorities have also moved toward providing relief support to the victim’s family.

The government has ordered Rs 2 lakh relief assistance for Garima Chaudhary’s family as they continue waiting for the conclusion of the justice process.
